Bed Breakfast Scheme

Introduction:

Vide Notification No.F.6(11)/TSM/2007/Part file/941 dated 06.09.2007, in exercise of the powers conferred by Section 33 of the National Capital Territory of Delhi (Incredible India) Bed and Breakfast Establishments (Registration and Regulation) Act, 2007 (Delhi Act 11 of 2007), the Government hereby makes the following rules, namely:-

National Capital Territory of Delhi (Incredible India) Bed and Breakfast Establishments (Registration and Regulation) Rules, 2007. Vide Gazette Notification No. F.14(3)/LA-2007/LJ/07/7624 dated 10.12.2007 enacted by Legislative Assembly of the National Capital Territory of Delhi.

01 What is Bed & Breakfast (B&B)? Bed & Breakfast (B&B) means providing lodging and food services to the guest in an Establishment.
02 What is an Establishment? A residential premises Registered under Section 3 of the Act, where guests are provided Bed and Breakfast on payment is called an Establishment.
03 What is the concept of Bed & Breakfast? The basic philosophy of the Bed and Breakfast Scheme is that tourists, particularly the foreign ones should be provided an opportunity to stay with an Indian family, experience the Indian (local) way of life, discover the rich culture, relish the indigenous cuisine and forge an understanding with India and the Indian culture and traditions.
04 Is breakfast free at BnB? A home cooked breakfast shared with the guests is a much loved perk of the BnB experience. It is usually included in the price of your stay.
05 Does BnB included dinner” Most B&Bs do not have lunch or dinner for their guests (although a few do) but many will have afternoon snacks, vending machines or even wine and cheese tastings to choose from.
06 Is a BnB residential or commercial? BnB inns are unique, semi commercial operations that adopt a residential environment into a lodging concept limited in scope and operation.
07 What is the benefit of BnB license As per Section 16 of Bed & Breakfast Act, 2007, the establishment is not to be treated as Commercial Unit and shall only be liable to pay Power and water tariff as applicable to domestic or residential use and Property tax as applicable to residential tenanted premises with respect to the portion let out to the guest, thereof, fully or partly as the case may be.
08 What documents are required for registration of premises under BNB? Following documents (duly self attested) required for registration of premises under BNB: 1. Ownership proof of applicant (legal documents) i.e. Conveyance Deed, Sale Deed, GPA (Registered), Lease Deed or SPA/Authorization duly registered in case of applicant is not actual owner. 2. Police Verification Report (Form-B) of the applicant 3. ID proof of residence of applicant such as Driving License, Passport, Ration Card, Aadhaar Card, Voter ID. 4. Undertaking/Self Declaration by applicant on plain paper 5. Layout Plan of all floors (separately on A4 size sheet) 6. Family background note of the applicant.
09 Can PCC (Police Clearance Certificate) be accepted for Police Verification Report? No. As per rule 5 (b) of Bed & Breakfast Scheme, only Police Verification Report in Form-B shall be accepted. The format of Form-B is available on the website of department.
10 Whether ID proof of any other residence can be accepted? No. The applicant should have one of ID proofs such as Voter ID, Passport, Driving Licence, Ration Card and Aadhaar Card of the premises where the applicant applies for registration.
11 What is layout plan? Layout plan is dimensions of your rooms, bathrooms, drawing rooms, dinning room etc. which can be submitted on A-4 size paper.
12 Can a Lessee apply for registration? Yes. Subject to submission of Registered Lease Agreement and SPA. The owner of property shall issue a Special Power of Attorney/ Authorization duly registered with validity of minimum 04 years in favour of applicant. The format of SPA is available on the website of department.
13 How can I promote my Bed & Breakfast? Below are some of the most effective ways to promote the BNB:- 1. Your own website 2. Travel websites 3. Online directories 4. Pay per click advertising 5. Get Quality ratings 6. Customer reviews 7. Social Media
14 Is it mandatory for the owner to reside at the B&B Establishment? Yes. As per Section 3(3)(a) of B&B Act, 2007 – “that the premises is purely a residential unit and the owner has been physically residing therein along with his family and having at least one of the following documents as his proof of residence, such as voter Identity Card or passport or driving license or ration card.” A Bed & Breakfast is generally a small Establishment with one to six guest rooms. The owners live on site and interact with travelers as if they were invited guests rather than anonymous temporary room numbers.

16 Who can apply? Any person intending to let out part of his residential premises to the guests may apply for registration thereof as an establishment to the prescribed authority, in such form and manner alongwith the registration fees as may be prescribed in the in the B&B Act & Rules made thereunder.
17 If, I am residing in NCR (Noida, Gurgaon, Ghaziabad etc.), can apply in NCT of Delhi? No, only those establishments in NCT of Delhi registered by Central Government under the Incredible India Bed & Breakfast Establishments Scheme shall be deemed to have been approved and registered under this Act. 18 What is the registration fee? Rs.3,000/- for Silver Category & Rs. 5,000/- for Gold Category
19 Whether the fees is refundable? No. The fees paid shall not be refundable in any circumstances, either in full or in part.
20 What is difference between Silver and Gold Categories? It depends on the quality of accommodation, facilities and services provided for example– Parking facility Gold – Mandatory Silver – Desirable Telephone with extension facility Gold – Mandatory Silver – Desirable Washing Machine & Dryers Gold – Mandatory Silver – Desirable Refrigerator in the Room Gold – Mandatory Silver – Desirable Security Guards Gold – Mandatory Silver – Desirable For details please refer to Check-List (Form-C) of Bed & Breakfast Scheme.

22 Can application form may be submitted manually in the Tourism office? No. Only online applications are accepted..
23 What is the mode of registration fees? 1. Demand Draft (in favour of Pr. Secretary, Tourism, GNCT of Delhi) 2. Online payment
24 How many Rooms can be registered in this scheme? 2/3rd of the total rooms available in the premises with a capping of maximum 06 Rooms.
25 What should be the size of Rooms? 120 Sq. Feet for Silver Category 200 Sq. Feet for Gold Category
26 What should be the size of attached Bathrooms? 30 Sq. Feet for Silver Category 40 Sq. Feet for Gold Category
27 What is time period of delivery of service? Maximum 90 days (on completion of all documents)
28 What is the validity of license/certificate once issued? 03 Years from the date of issue of registration certificate
29 What is procedure for its renewal? There is no procedure for renewal. On expiry of registration certificate, the applicant has to apply afresh.
30 In case of rejection of application where can one appeal? After rejection of application, one can make an appeal before the Appellate Authority/Secretary (Tourism) Government of NCT of Delhi within 30 (thirty) days of the date of communication of the rejection order.
